1. Acceptance

These Terms of Service ("Terms") are an agreement between you and Yamavista 株式会社, a corporation organized under the laws of Japan (Corporate Number 8011701027785), operating 今日宜 Today Yi / TodayYi.com ("we", "us"), governing your use of the website and the daily almanac service (the "Service"). By creating an account, starting a trial or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old (or the age of majority where you live, if higher) and able to form a binding contract.

3. The Service; entertainment disclaimer

The Service generates personalized daily almanac content (auspicious/inauspicious activities, lucky hours and directions, plain-language interpretations, small daily tasks, etc.) from the birth information you provide, based on the traditional Chinese calendar, displays it on the website and, with your consent, sends it to you daily on the messaging channel you choose (currently Telegram or phone notifications).

All content is for cultural and entertainment purposes only. It is not medical, psychological, legal, financial, investment or any other professional advice, and it does not predict or guarantee any outcome. Do not rely on the Service for important decisions; consult a qualified professional where appropriate.

4. Your account and accurate information

You sign in with one-time codes sent to your email. Keep your email account secure; you are responsible for activity under your account. Provide accurate birth information and keep it up to date. Personalization depends on the information you provide, and we are not responsible for content based on inaccurate information.

5. Subscriptions, free trial, automatic renewal and cancellation

• Plans and prices: US$4.99 per month or US$29.99 per year. All prices are tax-inclusive; no tax is added at checkout, and any applicable tax is calculated from that price and remitted by Stripe.
• Free trial: one 3-day free trial per account (and per payment identity). A valid payment method is required to start. Canceling during the trial costs nothing.
• Automatic renewal: unless you cancel before the trial ends, you will be charged for your chosen plan when the trial ends, and your subscription will then renew automatically every month or year on the renewal date, and your payment method will be charged, until you cancel. By starting a trial you agree to this automatic renewal and authorize these recurring charges.
• Acknowledgment: after your subscription starts you will receive an email confirmation/receipt that includes the plan, price, renewal term and how to cancel.
• How to cancel: anytime online at "我的订阅 / My subscription → 管理订阅 / Manage subscription" at the very bottom of the homepage (Stripe customer portal), or by emailing info@todayyi.com. Online cancellation is as easy as signing up and never requires a phone call.
• When cancellation takes effect: at the end of the current paid period; you keep access until then and will not be charged again. Except as stated in our Refund Policy, partial periods are not prorated or refunded.
• Price changes: we will notify you by email at least 30 days in advance of any price change, which will apply from the next renewal after the notice period; you may cancel before it takes effect.
• Failed payments: if a renewal charge fails, Stripe may retry it and we may suspend paid features until payment succeeds or the subscription ends.

6. Refunds

Refunds are handled under our Refund Policy, which forms part of these Terms. Refunds are returned to the original payment method via Stripe. Your statutory rights under applicable law are not affected.

7. Stripe as merchant of record

The Service is offered by Yamavista 株式会社 (see our Specified Commercial Transactions Act disclosure). Payments are processed by Stripe through Stripe Managed Payments. Stripe is the merchant of record for your purchase and handles payment collection, tax calculation and remittance, fraud prevention and disputes. Prices shown on the Service (US$4.99/month, US$29.99/year) include tax. Your statement and receipts may show Stripe or Link. Stripe's terms and privacy policy also apply to its processing of your payment. We never see or store your full card number.

8. Daily messages and opt-out

We send daily almanac messages only after you choose and link a delivery method. We currently support Telegram and phone notifications (web push); we may add other messaging channels in the future, which will also be used only if you choose them. On Telegram, send 退订 or /stop at any time to opt out, or 帮助 for help; phone notifications can be turned off on the website's delivery settings page or in your device settings. Opting out of messages does not cancel your subscription — to stop charges, cancel as described in Section 5. Your carrier's data charges may apply. Delivery depends on Telegram, browser/operating-system push services and networks, and we cannot guarantee timely delivery of every message.

9. Acceptable use

You agree not to: use the Service unlawfully; access, interfere with or disrupt the Service or its security without authorization; scrape content at scale with bots or other automated means; resell, republish or commercially exploit Service content; impersonate others or submit another person's information without authorization; or abuse the free trial (for example, by creating multiple accounts to obtain repeated trials).

10. Intellectual property and license

The Service and its content (including written interpretations, design, images, software and the 今日宜 / Today Yi name and logo) are owned by us or our licensors. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the Service content for your personal, non-commercial use. You may share occasional screenshots of daily content with friends and family for non-commercial purposes. Traditional calendar data itself is part of the public cultural heritage and we claim no rights in it.

11. User content

Currently the Service only records check-in dates and the system-generated daily task; there is no feature for submitting free text or images. If we add such features, you keep ownership of your content and grant us a limited license needed to provide the Service, and you are responsible for ensuring your content is lawful and does not infringe others' rights.

12. Third-party services

The Service relies on third parties (such as Stripe, Telegram, browser push services, Supabase, Resend and Hostinger). Your use of them is also subject to their terms. We are not responsible for the availability or conduct of third-party services.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted or error-free or that content will lead to any result. Some jurisdictions do not allow the exclusion of certain warranties, in which case these exclusions apply only to the extent permitted.

14. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or loss of profits, data or goodwill, and our total liability for all claims relating to the Service will not exceed the greater of the amount you actually paid for the Service in the 12 months before the claim arose or US$50. Nothing in these Terms limits liability that cannot be limited or excluded by law (such as liability for willful misconduct or gross negligence, or your rights under applicable consumer protection laws).

15. Indemnity

To the extent permitted by law, you agree to indemnify us against reasonable losses and expenses arising from third-party claims caused by your breach of these Terms or unlawful use of the Service.

16. Termination and suspension

You may cancel your subscription at any time and request account deletion by email. We may suspend or terminate your account if you materially or repeatedly breach these Terms, for suspected fraud or abuse, or where required by law; if we terminate a paid subscription other than for your breach, we will refund the unused portion pro rata. Provisions that by their nature should survive termination (including Sections 10 and 13–18) will survive.

17. Governing law and venue

These Terms and any dispute arising from them are governed by the laws of Japan, without regard to conflict-of-laws rules. You and we agree that the Tokyo District Court has exclusive jurisdiction as the court of first instance for disputes relating to these Terms or the Service, except that: (a) either party may use small-claims procedures (少額訴訟) in a Japanese summary court where eligible; and (b) if you are a consumer, nothing in these Terms deprives you of the protection of mandatory consumer protection laws of your country of residence that cannot be waived by contract, including any right to bring proceedings in your local courts. These Terms contain no arbitration clause and no class-action waiver.

18. Changes to these Terms

We may update these Terms. The updated version will be posted on this page with a new "Last updated" date; for material changes (especially to pricing or renewal) we will notify you by email in advance. Continuing to use the Service after changes take effect means you accept them; if you do not agree, you may cancel before they take effect.

19. General

Severability: if any provision is held invalid, the rest remain in effect. Entire agreement: these Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Service. Assignment: you may not assign these Terms without our consent; we may assign them in connection with a business transfer with notice to you. No waiver: our failure to enforce a right is not a waiver of it.

20. Language

These Terms are provided in Chinese and English. The Chinese version is provided for convenience; if there is any inconsistency, the English version controls and governs legal interpretation.
